IMPORTANT — PLEASE READ CAREFULLY. These Terms contain a RELEASE OF LIABILITY (Section 9), an ARBITRATION AGREEMENT (Section 19), and a CLASS ACTION WAIVER (Section 19). By using the Service, you agree to resolve disputes with us through binding individual arbitration and you WAIVE THE RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. If you do not agree, do not use the Service.
Welcome to What the MAHJONG!. These Terms of Service ("Terms") govern your access to and use of the What the MAHJONG! application, website, and related services (collectively, the "Service") provided by What The Mahjong LLC (doing business as "What the MAHJONG!" — hereafter "we," "us," or "our").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to use What the MAHJONG!. Because our Service facilitates in-person meetings at private residences, we restrict our platform to adults for safety reasons.
United States only. The Service is intended for and made available only to users physically located in the United States. You may not access or use the Service from any other country. We do not represent that the Service is appropriate or available in any other jurisdiction. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws.
Sanctions and export controls. You represent that you are not located in, and are not a national or resident of, any country subject to U.S. government embargo or that has been designated by the U.S. government as a "terrorist supporting" country. You are not listed on any U.S. government list of prohibited or restricted parties.
By using the Service, you represent that you are 18 or older, that all information you provide about your age is accurate, and that you have the legal capacity to enter into these Terms. We reserve the right to terminate any account we reasonably believe belongs to a person under 18 or located outside the United States.
If you misrepresent your age or location, you agree to indemnify and hold us harmless from any claims, damages, or expenses arising from that misrepresentation.

You may not impersonate another person or create an account using false information. We reserve the right to close accounts we reasonably believe are duplicates of an existing account by the same person.
Accounts are non-transferable. You may not sell, transfer, gift, or bequeath your account to another person. In the event of a user's death or incapacitation, we may honor requests from verified next-of-kin to delete the account, at our sole discretion. We do not provide account access, data exports, or content to next-of-kin except as required by law.
What the MAHJONG! is a platform that helps mahjong players find and host games in their area. The Service allows you to:
What the MAHJONG! is a connection platform only. We do not organize, supervise, participate in, or endorse the games, classes, leagues, tournaments, or events posted by users. We do not conduct background checks, verify the identity, safety, qualifications, or intent of any user — including hosts, teachers, instructors, sponsors, or event organizers — and we do not vet the accuracy of any listing. Any designation shown in the Service (such as an "approved instructor" status) reflects only that the person has completed our internal account process; it is NOT a certification, license verification, background check, or guarantee of that person's skill, qualifications, safety, or trustworthiness. You interact with other users at your own risk, and any in-person meeting arising from the Service is solely between you and the other user(s).
Hosts are not our employees, agents, or representatives. Each host acts as an independent individual, not on behalf of What The Mahjong LLC. We are not responsible for the conduct, safety practices, or actions of any host or player.
Some games may involve an entry fee ("Price" or "Buy-In") that the host collects from players in person, in cash, at the physical location of the game. What the MAHJONG! does not process, hold, escrow, refund, or facilitate any payments between users. All money exchanged is a private transaction between the host and players, occurring entirely outside of the Service.
You are solely responsible for:
We do not verify identity, guarantee performance, or mediate disputes over off-app payments. If you are scammed, defrauded, or otherwise harmed by another user's payment conduct, you agree that we are not responsible.
We do not vet instructors, event organizers, league operators, or sponsors. Some games and events — including Teacher Classes, Pay to Play games, Leagues, Tournaments, Sponsored events, Charity events, and Getaways — may involve a fee charged by the host, teacher, or organizer. Whether or not that person holds any "approved" or paid designation within the Service, we do not verify their credentials, certifications, insurance, business licensing, or ability to safely or competently deliver what they advertise. You are solely responsible for evaluating any instructor, organizer, or event before paying for or attending it.
The Service may in the future offer optional in-app purchases (such as premium features, subscriptions, or business accounts). Those transactions will be processed through Apple's App Store, Google Play, or another authorized payment processor, subject to their terms. Business accounts and sponsors are responsible for their own listings, tax obligations, and refund policies.
You are solely responsible for any content you post, share, or transmit through the Service, including game listings, profile information, photos, ratings, and messages ("User Content"). By posting User Content, you grant What The Mahjong LLC a non-exclusive, royalty-free, worldwide, sublicensable license to display, distribute, store, reproduce, modify, and use the content in connection with operating, promoting, and improving the Service. You retain ownership of your User Content.
Photo and image rights. When you upload any photo or image (whether to your profile, in a message, or in a group chat), you represent and warrant that:
Feedback and suggestions. If you provide feedback, suggestions, or ideas about the Service (whether by email, in-app, or otherwise), you agree that we may use, implement, and commercialize that feedback without any obligation to compensate you or credit you. Any such feedback becomes our property.
You agree NOT to use the Service to:
What the MAHJONG! has zero tolerance for objectionable content or abusive behavior. Violations may result in immediate removal of your content, suspension, or permanent termination of your account, at our sole discretion.
Any content you send through direct messages, group chats, or other communication features may be captured by screenshot or otherwise reproduced by the recipient. We cannot prevent this. You acknowledge that any content you share may be seen, saved, or redistributed by others outside our control. Do not share content you would not want reproduced elsewhere.
If you encounter content or a user that violates these Terms, please report it using the in-app reporting tools. What the MAHJONG! reviews reports and takes appropriate action, which may include:
We aim to review reports within 24 hours of submission but do not guarantee this timeline. We are not obligated to take any specific action in response to a report.
Section 230 Immunity. As an interactive computer service, we are protected from liability for User Content under Section 230 of the Communications Decency Act (47 U.S.C. § 230). We are not the publisher or speaker of User Content, and we may moderate User Content in good faith without losing this protection.
When you post a game, you are responsible for accurately describing it and complying with all applicable laws. If you host a game at your home, you accept the risks of inviting other users into your residence. You are solely responsible for the safety of your home, guests, and any property. Home addresses are only shared with players you approve.
When you join a game, you are responsible for showing up on time, being respectful to the host and other players, and complying with the host's posted rules. Repeated no-shows may result in account restrictions.
You acknowledge that in-person meetings between strangers carry inherent risks, including physical injury, property damage, theft, harassment, and other harm. Mahjong itself may cause repetitive strain, and gathering in another person's home may involve slip, trip, fall, or other injury risks. What the MAHJONG! does not conduct background checks on users, verify the safety of hosting environments, or supervise gameplay. You assume all such risks.
BY USING THE SERVICE, YOU RELEASE, WAIVE, AND FOREVER DISCHARGE What The Mahjong LLC, its officers, members, employees, agents, and affiliates from any and all claims, demands, damages, injuries, losses, or expenses of any kind (including personal injury, illness, property damage, emotional distress, or death) arising out of or related to:
This release applies whether the injury or loss is caused by the negligence — ordinary or gross — of What The Mahjong LLC or any other party. Some jurisdictions do not permit the release of gross negligence or intentional acts; in those jurisdictions, this release applies to the maximum extent permitted by law.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share your information.
By creating an account, you consent to receive certain communications from us, including:
TCPA Consent. If you provide a phone number, you consent to receive automated calls or text messages from us or our service providers relating to your account or the Service. Message and data rates may apply. You may revoke this consent at any time by replying STOP to any text message, contacting us at support@whatthemahjong.com, or removing your phone number from your account. Consent is not a condition of using the Service.
The Service allows users to rate and review hosts, players, and games. By submitting a rating or review:
We are not responsible for the accuracy of any user rating or review. Reviews reflect the opinions of the users who submit them, not the views of What The Mahjong LLC. As an interactive computer service under Section 230, we are not liable for user-submitted ratings or reviews.
The Service, including its design, code, logos, and trademarks, is owned by What The Mahjong LLC and protected by intellectual property laws. You may not copy, modify, reverse engineer, or create derivative works of the Service without our written permission.
If you believe content on the Service infringes your copyright, please refer to the DMCA section of our Privacy Policy or contact our DMCA agent at support@whatthemahjong.com.
The Service may contain links to or integrate with third-party services (such as Google Maps, OneSignal, Apple App Store, Google Play, Supabase, Vercel, Resend, Sentry, and others listed in our Privacy Policy). We are not responsible for the content, privacy practices, or actions of any third-party service. Your use of third-party services is subject to their own terms and privacy policies.
From time to time, we may offer features designated as "beta," "preview," "experimental," or similar. Such features are provided "as is" without any warranty, may contain bugs or errors, and may be modified, suspended, or discontinued at any time without notice. Your use of beta features is at your own risk.
In the event of a data breach affecting your personal information, we will make reasonable efforts to notify you and applicable authorities in accordance with applicable law. Notification methods may include email, in-app notice, or public posting on our website. We are not liable for any delay in notification caused by circumstances beyond our reasonable control.
You may delete your account at any time from within the app (Profile → Delete My Account). Upon deletion, your account and personal data will be removed in accordance with our Privacy Policy, subject to a 7-day grace period during which you may restore your account.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including:
Sections that by their nature should survive termination (including Sections 5, 9, 13, 14, 15, 18, 19, 20, 21, 22, and 23) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

You assume all risks associated with using the Service and interacting with other users.
Before initiating any arbitration or lawsuit, you agree to first contact us at support@whatthemahjong.com and attempt to resolve the dispute informally. We agree to make good-faith efforts to resolve any dispute during a 30-day informal negotiation period. If the dispute is not resolved after 30 days, either party may initiate arbitration.
ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE (INCLUDING THE VALIDITY OF THIS ARBITRATION AGREEMENT) WILL BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION, NOT IN COURT, EXCEPT AS PROVIDED BELOW.
Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Collin County, Texas, or via video conference at your election. The arbitrator's decision is final and binding.
The following disputes are not subject to arbitration:
YOU AND WE AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR WE MAY PARTICIPATE IN A CLASS, CONSOLIDATED, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
YOU AND WE WAIVE THE RIGHT TO A JURY TRIAL for any dispute subject to arbitration or any exception listed above.
You may opt out of this arbitration agreement by sending written notice to support@whatthemahjong.com within 30 days of first accepting these Terms. The notice must include your name, email address, and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other provisions of these Terms.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHAT THE MAHJONG LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless What The Mahjong LLC and its officers, members, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys' fees) arising out of or relating to:
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute not subject to arbitration shall be resolved exclusively in the state or federal courts located in Collin County, Texas, and you consent to the personal jurisdiction of those courts.
If you download or use the Service through the Apple App Store, you acknowledge and agree that:
We may update these Terms from time to time. If we make material changes, we will notify you via email, in-app banner, and by posting on our website, at least 14 days before the changes take effect. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the changes, you must stop using the Service and delete your account.
