This End User License Agreement ("EULA") is a legal agreement between you ("User," "you," or "your") and What The Mahjong LLC, doing business as "What the MAHJONG!" ("we," "us," or "our") governing your use of the What the MAHJONG! mobile application, web application, and any related software (collectively, the "App").
By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree, do not download or use the App.
Subject to your compliance with this EULA and our Terms of Service, What The Mahjong LLC grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial use in accordance with this EULA.
You must be at least 18 years old to use the App. The App is intended for and made available only to users physically located in the United States. You may not access or use the App from any other country.
Export Controls and Sanctions. You represent that you are not located in, and are not a national or resident of, any country subject to U.S. government embargo or that has been designated by the U.S. government as a "terrorist supporting" country. You are not listed on any U.S. government list of prohibited or restricted parties.

The App is licensed to you, not sold. What The Mahjong LLC retains all right, title, and interest in and to the App, including all intellectual property rights. Nothing in this EULA transfers any ownership rights to you.
The App integrates with or relies on third-party services, including but not limited to Supabase (database and authentication), Vercel (hosting), Google Maps (mapping), OneSignal (push notifications), Resend (email delivery), and Sentry (error monitoring, when active). Your use of those services is subject to their respective terms and privacy policies. What The Mahjong LLC is not responsible for the availability, accuracy, or conduct of any third-party service.
If you downloaded the App from the Apple App Store or Google Play Store, the following applies:
What the MAHJONG! may from time to time release updates, upgrades, or new versions of the App. This EULA applies to all such updates unless accompanied by a separate license. We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice.
Content you create, upload, or transmit through the App (such as game listings, profile information, photos, and messages) remains your responsibility. By submitting content, you grant What The Mahjong LLC a license to use it as described in our Terms of Service. What The Mahjong LLC does not claim ownership of your content.
If you believe content in the App infringes your copyright, please send a DMCA notice to our designated agent as described in our Privacy Policy. We will respond to valid DMCA notices in accordance with the Digital Millennium Copyright Act.
Your use of the App is subject to our Privacy Policy, which is incorporated into this EULA by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WHAT THE MAHJONG! DOES NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS OR THAT DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHAT THE MAHJONG LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THIS EULA OR YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.
You agree to indemnify, defend, and hold harmless What The Mahjong LLC and its officers, members, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App, your violation of this EULA, or your violation of any rights of another person.
This EULA is effective until terminated. Your rights under this EULA terminate automatically, without notice from What the MAHJONG!, if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies in your possession. Sections 4, 11, 12, 13, and 15 survive termination.
This EULA is governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising under this EULA shall be resolved in accordance with the dispute resolution provisions of our Terms of Service, including binding individual arbitration and class action waiver. Any dispute not subject to arbitration shall be resolved exclusively in the state or federal courts located in Collin County, Texas. You consent to the personal jurisdiction of those courts.
This EULA, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and What The Mahjong LLC with respect to the App and supersedes all prior agreements and understandings.
